1. Who the supplier is
The services are provided by Michal Muskolay, registered office Vinohradská ulica 2778/6C, 931 01 Šamorín, Slovakia, Company ID (IČO) 55074766, Tax ID (DIČ) 1126204266, entered in the Trade Register of the District Office Dunajská Streda, trade register number 210-44182 (the “supplier”).

2. Subject of the contract
The subject of the contract is the photographic and video recording of a wedding day to the extent of the chosen package, and the subsequent delivery of the edited work to the client.
The specific scope — the number of hours, the number of photographs, the length of the film and any extras — is set out in the confirmed order. Prices shown on the website are indicative; the binding price is the one stated in the confirmed order.
3. Booking a date
The contract comes into being when the supplier confirms the order and the booking deposit is paid. The deposit is at most 40 % of the package price and is payable before the wedding date. The remainder is paid after the work is delivered.
A date is reserved only once the deposit has been credited. Until then it may be taken by someone else. The supplier normally takes on one booking per day.
4. Price and payment
- The balance of the price is payable after the work is delivered.
- Travel within 50 km of the registered office in Šamorín is not charged. Beyond 50 km, travel is charged at 0.30 € per kilometre.
- Work beyond the agreed hours is charged at 50 € per hour, by agreement on the day.
- For multi-day or distant weddings, accommodation may be charged.
5. Cancellation and moving the date
Cancellation by the client
Please give notice of cancellation in writing. Depending on how close to the date it happens, the supplier retains:
- no later than 3 days before the date — 20 % of the order price
- less than 3 days before the date — 30 % of the order price
- on the wedding day itself — the whole deposit paid
The amount retained covers bookings for the same date that the supplier turned down because of the reservation.
Moving the date
The date may be moved once without penalty, provided the new date is free and the change is notified at least one month in advance. If the supplier is not available on the new date, the cancellation terms apply.
Cancellation by the supplier
If the supplier cannot provide the service because of illness, injury or another serious obstacle, they will try to arrange a replacement of comparable quality. If that is not possible, all payments made, including the deposit, are refunded.
6. How the wedding day runs
- The client provides the schedule for the day, and a contact for the coordinator if there is one, at the latest 7 days before the date.
- The supplier needs access to the venues and the consent of whoever manages them (church, registry office, hall).
- Where a venue restricts photography or filming, the supplier respects those rules.
- For work lasting more than 5 hours, the supplier is entitled to a meal break.
- The client is responsible for informing guests that a photographer and a filmmaker will be present.
7. Delivery of the work
- Film — both the long and the short cut within 4 weeks of the date
- Photographs — within 4 weeks of the date
The work is handed over on a physical USB drive in a gift box. By arrangement the supplier will also make it available through cloud storage (Google Drive) for at least one year. The periods run from the wedding date and begin once the price has been paid in full.
The selection of shots, the edit, the colour grading and the music are the supplier's creative decisions in their established style. Unedited source files are not part of the delivery.
8. Copyright and licence
Photographs and films are copyrighted works. Copyright remains with the supplier; the client receives a licence to use the work.
What the licence covers
- Unlimited personal use, including printing and archiving
- Sharing on your own social media
- Giving copies to family and guests for their personal use
What the licence does not cover
- Commercial use and resale without a written agreement
- Altering the work — cropping, filters, recolouring, re-editing
- Removing the author's mark where it forms part of the work

9. Archiving and backups
The supplier keeps a backup of the finished work for at least one year from delivery. This is a courtesy, not a permanent archive — the client is obliged to back up the work once received. After that period the files may be deleted irretrievably.
10. Liability and force majeure
The supplier is responsible for producing the work to a professional standard. They are not responsible for circumstances beyond their control — the weather, delays to the schedule, restrictions imposed by the venue, the behaviour of guests, or moments that were not part of the agreed scope.
In the event of equipment failure or data loss despite backups, liability is limited to the amount of the price paid.
Where performance is impossible due to force majeure, the supplier undertakes to refund payments made for the part of the service not provided.
11. Complaints and disputes
Please make any complaint in writing to contact@deardayfilms.com without undue delay, and at the latest within 2 weeks of receiving the work. The supplier will deal with it within the statutory period.
If the client is a consumer and is not satisfied with how the complaint was handled, they have the right to ask the supplier to put it right. If the supplier replies in the negative or does not reply within 30 days, the client may propose alternative dispute resolution — the competent body is the Slovak Trade Inspection Authority (Slovenská obchodná inšpekcia). The European online dispute resolution platform may also be used.
12. Final provisions
Matters not governed by these terms are governed by the law of the Slovak Republic. Deviations agreed in writing in the order take precedence over these terms.
The supplier may amend these terms; orders already concluded are governed by the wording in force when they were confirmed.
